JUSTICE SOUMITRA SAIKIA ORDER 08.05.2026 Heard Mr. YS Mannan, learned counsel for the petitioner. Also heard Mr. B Chowdhury, learned Standing Counsel, Agriculture Department. 2. The petitioner is aggrieved by the impugned transfer order dated 17.09.2025 issued by the respondent no.2, whereby the petitioner stood transferred from the Office of the District Agriculture Officer, Kamrup, Amingaon. Presently the petitioner is posted in the Office of the Assistant Director of Agriculture (Admn.) at Headquarters. The petitioner is serving as a Grade-IV employee and she is superannuating next year. In addition thereto, the petitioner suffered a fractured leg and had applied for leave and thereafter, she has been suffering from some medical ailments and all these were reflected in the representation which the petitioner had filed before the Director of Agriculture on 16.03.2026 but the same has not been considered. Being aggrieved, the petitioner is before this Court. 3. Mr. B Chowdhury, learned Standing Counsel, Agriculture Department submits that he has no instructions in the matter. 4. Learned counsel for the parties submit that at this stage the concerned Page No.# 3/3 respondent may be directed to consider the representation dated 16.03.2026 filed by the petitioner. 5. Considering the submissions made by the learned counsel for the parties and the limited prayer made before this Court, this Court is of the considered view that the ends of justice will be met if the writ petition is disposed of at this stage without issuing any notice to the respondents, however, only with the directions to the Director of Agriculture, Assam, Khanapara to expeditiously consider and dispose of the representation stated to have been filed by the petitioner on 16.03.2026. The authorities will consider the case of the petitioner sympathetically and thereafter, may pass appropriate orders in respect of the grievances ventilated in respect of the transfer issued to the petitioner by the impugned transfer order dated 17.09.2025. The representation dated 16.03.2026 be disposed of within 2 (two) weeks from the date of receipt of certified copy of this order. Till such an order is passed by the Department, the impugned transfer order dated 17.09.2025 in so far as the writ petitioner is concerned will not be given effect to.
