No. 2154 of 2026 __________ Page2 of 6 ORDER This Writ Petition has been filed challending the order of the 2nd Respondent in Na.Ka.No.05/Sulthanpet Police Station/2026 dated 17.08.2026 and quash the same and accordingly direct the respondents to grant permission and accord adequate police protection to conduct the cultural program (Palsuvai Kalai Nigazhchi) on 23.08.2026 between 07.00 PM and 10.00 P.M in connection with the Mahagumbhabishekam festiaval of Arulmigu Sri Mahakali Amman Temple at Sulthanpet, Sulur Taluk, Coimbatore District. 2. The petitioner wants to conduct the Cultural Program (Palsuvai Kalai Nigazhchi) on 23.08.2026 between 07.00 PM and 10.00 P.M in connection with the Mahagumbhabishekam festiaval of Arulmigu Sri Mahakali Amman Temple at Sulthanpet, Sulur Taluk, Coimbatore District.. He made a request to the police to grant permission and protection and the same had been refused. Hence, the petitioner is before this Court. 3. Mr.T.Balaji relies upon the earlier order passed by this Court in R.Thirugnanam Vs. The District Collector, Ariyalur & Others, W.P.Crl.No.1321 of 2026 dated 10.06.2026, wherein permission was granted to conduct the cultural program with certain conditions. https://www.mhc.tn.gov.in/judis

4. It is the plea of Mr.Yogaraja Sekar that the police fears that the petitioner might indulge in obscene activities and political speech and hence permission ought not be granted. 5. I have gone through the order passed by Justice Mr.G.K.Ilanthiraiyan on 10.06.2026 in W.P.No.1321 of 2026.
He had imposed several conditions prior to granting permission for the petitioner therein to hold the function. The same conditions are reiterated with respect to the petitioner in the present case also. 6.Accordingly, the order impugned herein is set aside and this Writ Petition is disposed of subject to the following conditions: (a) The cultural programme (Palsuvai Nigazhchi) in connection with the Mahagumbhabishekam festival of Arulmigu Sri Mahakali Amman Temple at Sulthanpet, Sulur Taluk, Coimbatore District to be held on 23.08.2026, shall be conducted as per the petitioner’s representation dated 15.08.2026. (b)The petitioner shall pay a sum of Rs.10,000/-(Rupees Ten Thousand Only) to the respondent Police and on receipt of the same, the respondent Police is directed to issue receipt and proceed further. (c)There should not be any kind of obscene dance or vulgar dialogues during the festival / celebrations by any of the participants. (d) Double meaning songs should not be played so as to spoil https://www.mhc.tn.gov.in/judis
WP Crl. No. 2154 of 2026 __________ Page4 of 6 the minds of students and youth. (e) No dance or songs, touching upon any political party or religion or community or caste, shall be played. (f) No flex boards in support of any political party or communal leader shall be erected at the premises of the programme. (g) The function shall not affect either the religious or communal harmony and shall be conducted without any discrimination based on caste. (h) If there is violation of any one of the conditions imposed, the concerned police officer is at liberty to take necessary action, as per law and stop such performance forthwith; and (i) Similarly, the police is directed to stop the dance programme, if it is played beyond the permitted time limit. The respondents are directed to issue necessary permission, incorporating the above conditions. 7. As Mr.A.Yogaraja Sekar apprehends that the petitioner might indulge in obscene activities, if there is any such violation, the police shall invoke the appropriate provision and do the needful. 8.
The respondent police shall submit a report before this Court on 28.08.2026 with regard to the compliance of this order. In the event the report discloses that the petitioner indulged in any of the activities contrary to the conditions imposed by this Court in this order, action, including the suo motu contempt https://www.mhc.tn.gov.in/judis
