JUSTICE PARTHIVJYOTI SAIKIA ORDER 19.05.2026 Heard Mr. S M Abdullah P, learned counsel appearing the petitioner. Also heard Mr. K Borthakur, learned Additional Public Prosecutor, Assam. By this application filed under Section 482 of the BNSS, 2023 the petitioner, namely, Kiran Ali, has prayed for pre-arrest bail who apprehends arrest in connection with Tezpur P.S. Case No. 246/2026. A girl has alleged in the FIR that the petitioner Kiran Ali was maintaining relationship with her in fact they were in love. On promising of marriage, the petitioner was also maintaining physical relationship with her for the last (2) years. Later on, the girl came to know that the petitioner was maintaining relationship with another girl also and he was avoided her. I have considered the submissions made by the learned counsel for both the sides. Under the given circumstances, the petitioner does not deserve to be detained in custody. Hence, the prayer for pre-arrest bail is allowed. Accordingly, it is hereby directed that in the event of arrest of the petitioner Kiran Ali in connection with Tezpur P.S. Case No. 246/2026, the arresting authority shall release him on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the arresting authority. The bail application is disposed of.
