This bail application has been filed under Sections 483 and 484 of the Bhartiya Nagarik Suraksha Sanhita, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody in Special POCSO Case no.33 of 2025 arising out of Lohardaga P.S. Case No. 172 of 2025 for allegedly committing offence punishable under Section 70(2) of the B.N.S. and Section 4/6 of the POCSO Act which is pending in the Court Learned Additional Sessions Judge-I-Cum-Special Judge POCSO Act, Lohardaga. 4. Heard, learned counsel for the petitioner, learned counsel for the State and perused the statement of the victim recorded under Sections 180 and 183 of the B.N.S.S. 5. Learned A.P.P. opposes the prayer for bail. 6. It is the case of gang rape. The victim girl supports the aforesaid fact in her evidence recorded under Sections 180 and 183 of the B.N.S.S. which was called for by this Court earlier. She has also stated the name of this petitioner along with others. 7. Considering the aforesaid statement, I am not inclined to release this petitioner on bail as this petitioner needs to be identified during trial, this bail application is hereby dismissed with a liberty to renew his bail 2026:JHHC:6103 2 application after examination of the victim as prosecution witness. 8.
