1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.257/2024 registered at Police Station Kotwali, District Jagdalpur (CG) for the offences under Sections 294, 363, 376, 392, 394, 506 Part II IPC.
2. As per the prosecution case, on 15.06.2024 at about 5.00 a.m., the applicant has intimidated the victim and looted Rs.2000/- from her and Rs. 2000/- from eye witness Samlu Baghel. It is further alleged that at the point of knife, the applicant abducted the victim from the lawful custody of her guardian and committed forcible sexual intercourse with the victim without her consent and further threatened to kill her. Learned counsel for the applicant submits that it is clear from the victim’s court statement that she has not identified the applicant while examining her in Court and further the FSL report shows negative result. Even the doctor has not given any definite opinion regarding sexual assault. He submits that from cross examination of victim, the fact of false implication cannot be denied. He submits that the applicant is in jail since 15.06.2024; there are total 14 witnesses yet to be examined and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the applicant was minor and there are 4 previous criminal antecedents reported against him. He further submits that Samlu is an eye-witnesses and his examination is yet to be concluded.
5. The victim along with her father has appeared through VC from the concerned DLSA and raised objection to grant bail.
6. Having considered the submissions made by learned counsel for the parties and further looking to the over all facts and circumstances of the case, I am not inclined to release the applicant on regular bail. Accordingly, the bail application is rejected.
7. However, looking to the custody period of the applicant as he is stated to be in jail since 15.06.2024, the trial Court is directed to conclude the trial as early as possible preferably within a period of 3 months.
