(9th respondent is suo motu impleaded by this Court vide order dated 21.08.2026 in W.P.No.34392 of 2026 by KRJ) ..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus directing the respondents to consider the petitioner’s representation dated 11.08.2026 and thereby direct the 1 to 5 respondents to give admission of M.B.B.S. seat to the petitioner under the PwBD quota by considering his Disability card/certificate in UDID TN7350520050003403 after fulfilling the other conditions. Learned counsel appearing for the petitioner would submit that the petitioner has been suffering from a locomotor disability since childhood, https://www.mhc.tn.gov.in/judis WP No. 34392 of 2026 __________ Page3 of 6 resulting in a benchmark disability assessed at 60%. Consequently, the petitioner applied for NEET-UG for the academic year 2025-26 under the Persons with Benchmark Disabilities (PwBD) category and successfully qualified in the said examination. Thereafter, the petitioner was referred to the seventh respondent/the Medical Board for assessment. The Medical Assessment Board issued a certificate assessing his benchmark disability at 10%, concluding that he was ineligible for PwBD reservation since a minimum benchmark of 40% disability is mandatory under the governing guidelines. Aggrieved by the said certificate issued by the Medical Assessment Board, the petitioner has preferred an appeal dated 11.08.2026 and also sent an email dated 11.08.2026 to the respondents. However, the same was not considered. Under this circumstances, the petitioner has sent another representation through e-mail to the respondent and that was also not considered. Hence, this writ petition. 3. Learned Special Government Pleader appearing for the respondents would submit that the petitioner is supposed to make an application before the appellate authority viz., Madras Medical College, Chennai in a proper format. In the event the petitioner submits an appropriate application before the said authority, the same will be duly considered in accordance with law. 4. In view of the above submissions, the Dean / Chairperson, Madras Medical College, Chennai, is suo motu impleaded as the 9th respondent in this Writ Petition. Although the petitioner has filed an appeal before the 9th respondent, this Court feels that it would be appropriate for the petitioner to submit an appeal application once again in the correct format, along with a physical copy of the said appeal, to the 9th respondent. Upon such receipt, the 9th respondent-MMC, being the designated appellate authority, shall consider the appeal, conduct a reassessment of the petitioner’s disability, and pass appropriate orders on merits within a period of one week from the date of receipt of a copy of this order, thereby enabling the petitioner to participate in the ensuing NEET counselling if found eligible. 6. This Writ Petition stands disposed of with the above directions. No costs.
