Mr. Saurabh Kumar Pandey, learned counsel for the petitioner. 2. By the instant petition the petitioner is praying for expediting the proceeding of SCC Suit No. 82 of 2023 Rishi Kumar Agarwal vs. Krishna Avtar. 3. Learned counsel for the petitioner submits that petitioner has filed a civil suit before learned Civil Judge (Senior Division) Haldwani Nainital against the respondent for eviction on 29.05.2023 and petitioner is aged about 77 years. Respondent /defendant has already filed his written statement and now the matter pending for framing of issues but the respondent is deliberately seeking unnecessary adjournments, therefore, the trial court may be directed to expedite the matter. 4. The relief has sought appears to be innocuous. 5. In such view of the matter, the instant writ petition is disposed of finally with the direction to the SCC Court to expedite the proceeding of SCC Suit No. 82 of 2023 Rishi Kumar Agarwal vs. Krishna Avtar as early as possible preferably within four months from the date of production of certified copy of this order. 6. It is made clear that the SCC Court shall not grant any unnecessary adjournment to either of the parties since the parties who is the plaintiff is a senior citizen and aged about 77 years.
