For Petitioner : Mr.T.Pushkin Rajkumar ***** https://www.mhc.tn.gov.in/judis CRP No.4794 of 2026 __________ Page2 of 4 ORDER This Civil Revision Petition has been filed under Article 227 of the Constitution of India challenging the order passed in I.A.No.5 of 2026 in O.S.No.2116 of 2024 by the XIX Assistant City Civil Court, Chennai, wherein the application filed by the petitioner to initiate proceedings against the respondents/plaintiffs for perjury was dismissed on the ground that it is not maintainable. 2. Heard learned counsel for petitioner and perused the materials available on record. This Court also went through the order passed by the Court below. 3. The plaintiffs have filed the suit in O.S.No.2116 of 2024 before the Court below seeking the relief of recovery of money along with interest. In this suit, the petitioner, who is the defendant, filed a written statement denying the claim made by the plaintiffs. After the completion of pleadings, issues were framed and the parties went for trial. 4. During the course of trial, certain documents were marked on the side of plaintiffs. According to petitioner, the documents relied upon and the statement made before the Court by the witness clearly constitutes perjury for which action has to be initiated against the plaintiffs. https://www.mhc.tn.gov.in/judis CRP No.4794 of 2026 __________ Page3 of 4 5. The Court below, by order dated 09.07.2026, came to a conclusion that the validity and the genuineness of the documents marked through PW-1 is yet to be decided and therefore, the application filed by the petitioner is not maintainable and accordingly, dismissed the application. Aggrieved by the same, the present revision has been filed before this Court. 6. Learned counsel for petitioner, by relying upon the order passed in C.R.P.No.3044 of 2026 dated 14.05.2026, submitted that the Court below ought to have independently decided the issue of perjury without waiting for the final disposal of the suit and that such a procedure followed by the Court below is against the settled principle of law. 7. On carefully going through the order relied upon by the learned counsel for petitioner, it is seen that this Court has held that the Court is bound to independently see if a prima facie case is made out under Section 340 Cr.P.C. / 379 BNSS and the Court cannot await for the final disposal of the suit in this regard. 8. In the considered view of this Court, the Court below need not have rejected the application as not maintainable. Now that the petitioner has come with a specific case before the Court below stating that the documents relied upon are forged documents and perjury has been committed, this issue can be https://www.mhc.tn.gov.in/judis CRP No.4794 of 2026 __________ Page4 of 4 N.ANAND VENKATESH, J. gm independently considered by the Court below after affording opportunity to the respondents. The Court below need not tag this issue along with the final disposal of the suit. This clarity will sufficiently take care of the grievance expressed by the petitioner. This Civil Revision Petition is disposed of in the above terms. No costs.
