With the consent of the parties, the present petition is disposed of, by giving one opportunity to petitioner Manoj Jistu, who has been arrayed as accused, in a complaint, under Section 138 of Negotiable Instruments Act, titled as ‘Mukesh Sharma Versus Manoj Jistu’, pending in the Court of learned Additional Chief Judicial Magistrate, Rampur at Bushahr. 3. Consequently, the order dated 19.07.2025, passed by the Court of learned Additional Chief Judicial Magistrate, Rampur at Bushahr, in Complaint under 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:2477 Section 138 of Negotiable Instruments Act, titled as ‘Mukesh Sharma Versus Manoj Jistu’ is set aside. Petitioner Manoj Jistu, is directed to take steps for summoning of witnesses, within a period of seven days, from the date of appearance before the learned trial Court. Thereafter, DWs be summoned for the date fixed by the learned trial Court. It is further clarified that in case, despite service, of DWs, they do not appear, learned trial Court is at liberty to take coercive action against the DWs and in case, no steps have been taken, then the order dated 19.07.2025, shall stand revived. 4. With these observations, petition stands disposed of. 5. Parties through their Counsel are directed to appear before the learned trial Court on 18.01.2026, at 10:00 am. 6.
