PARSA ANANTH NAGESWAR RAO The Court made the following: COMMON ORDER: The Criminal Revision Case No.418 of 2019 has been filed under Sections 397 & 401 of the Code of Criminal Procedure, 19731 challenging the interlocutory order dated 11.02.2019 in Crl.M.P.No.4782 of 2018 in 1 ‘the Cr.P.C.,’ 4 C.C.No.764 of 2016 passed by the learned Judicial Magistrate of First Class, Special Mobile Court, Eluru (for brevity, ‘the learned Trial Court’). 2. The Criminal Revision Case No.419 of 2019 has been filed under Sections 397 & 401 of ‘the Cr.P.C.,’ challenging the interlocutory order dated 11.02.2019 in Crl.M.P.No.4776 of 2018 in C.C.No.786 of 2016 passed by ‘the learned Trial Court’. 3. The Criminal Revision Case No.420 of 2019 has been filed under Sections 397 & 401 of ‘the Cr.P.C.,’ challenging the interlocutory order dated 11.02.2019 in Crl.M.P.No.4773 of 2018 in C.C.No.793 of 2016 passed by ‘the learned Trial Court’. 4. No representation for the Petitioners. 5. Heard the learned counsel for Respondent No.2 and the learned Assistant Public Prosecutor. Perused the record. 6. The impugned order dated 11.02.2019 in Crl.M.P.No.4782 of 2018 in C.C.No.764 of 2016 was passed by ‘the learned Trial Court’, dismissing an application filed under Section 143-A of the Negotiable Instruments Act, 1881 (for brevity, ‘the N.I Act’). Aggrieved thereby, the Accused/Petitioner preferred the present Criminal Revision Case. 7. Likewise, the impugned order dated 11.02.2019 in Crl.M.P.No.4773 of 2018 in C.C.No.793 of 2016, passed by ‘the learned Trial Court’, dismissing an application filed under Section 143‑A of ‘the N.I Act’. Aggrieved thereby, the Accused/Petitioner preferred the present Criminal Revision Case. 5 8. Similarly, the impugned order dated 11.02.2019 in Crl.M.P.No.4776 of 2018 in C.C.No.786 of 2016, passed by ‘the learned Trial Court’, dismissing an application filed under Section 143‑A of ‘the N.I Act’. Aggrieved thereby, the Accused/Petitioner preferred the present Criminal Revision Case. 9. Indeed, a revision against interlocutory order is not maintainable as per Section 397(2) of ‘the Cr.P.C.’ The order impugned is undoubtedly an interim order. 10. The Hon’ble Apex Court in Sethuraman v. Rajamanickam2, Bhaskar Industries Ltd. v. Bhiwani Denim & Apparels Ltd.3, Girish Kumar Suneja v. CBI4, Amar Nath v. State of Haryana5, the Hon’ble Apex Court held that receiving of documents, summoning of the witnesses are all interlocutory in nature and against which no revision case is maintainable. 11. In view of the law laid down by the Hon’ble Apex Court in Sethuraman, Bhaskar Industries Ltd., Girish Kumar Suneja, Amar Nath supra the Criminal Revision case is not maintainable. 12. Further, on perusal of the e‑Courts case status report, the C.C.No.764 of 2016 ended in acquittal vide order dated 25.03.2022; C.C.No.793 of 2016 ended in acquittal vide order dated 14.09.2024; and C.C.No.786 of 2016 ended in acquittal vide order dated 26.11.2020, all on the file of the learned Judicial Magistrate of First Class, Special Mobile Court, Eluru. 2(2009) 5 SCC 153 3(2001) 7 SCC 401 4(2017) 14 SCC 809 5(1977) 4 SCC 137 6 13. In view of the above, the Criminal Revision Cases are dismissed as infructuous. No order as to costs.
