“to direct the respondents to revise the petitioner’s basic pension by including initial P.F. Contribution period for calculating basic pension and pay the difference in pension amount from the date of the petitioner’s retirement with 10% interest to the petitioner.”

The brief facts of the case are as follows:- 2.1 The petitioner joined the services of the respondent corporation as a Driver (Trainee) on 17.01.1986 and his services were subsequently regularised and made permanent on 03.09.1987. After rendering about 31 years of continuous service, the petitioner retired from service on 31.01.2017, While such being the case, while calculating his basic pension, the service rendered by the petitioner prior to his confirmation i.e., the period from 17.01.1986 to 03.09.1987 was not taken into consideration, despite the fact that P.F. contributions were deducted from the petitioner’s salary right from the date of his initial appointment. Aggrieved by the same, the petitioner made a representation dated 04.05.2026 before the respondents requesting the inclusion of his trainee service for pensionary benefits and to pay full pension. However, till date, no orders have been passed on the said representation. Hence, the petitioner has approached this Court by way of filing this Writ Petition seeking the above relief. https://www.mhc.tn.gov.in/judis

3. Heard the learned counsel appearing on either side and perused the materials available on record. 4.
Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the representation dated 04.05.2026, on merits and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. 5.
