B.Hariharan For Respondent(s): Mr.M.M.I.Khaleel, Govt.Advocate (Crl.Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 15.07.2026 for the alleged offence under Sections 126(2), 296(b), 309(4), 311, 351(3) of BNS, in Crime No.176 of 2026 on the file of the respondent police, seeks bail. 2. On 15.07.2026, at about 7.00 a.m, the petitioner along with other accused persons waylaid the defacto complainant, assaulted him, and robbed him of Rs.1,000/-. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner has been in judicial custody since 15.07.2026 and that the the petitioner is innocent and no way connected with the alleged offence and has been falsely implicated in this case, on account of previous cases pending against him. He further submitted that the co-accused/A2 and A3 have already been enlarged on bail by this Court. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has nine previous cases pending against him. He further submitted that the petitioner is a history-sheeter, bearing History Sheet No. 47 of 2020. Hence, he strongly opposed the grant of bail to the petitioner. 5. Considering the submissions of the learned counsel on either side, it is seen that this is a case of robbery. From the submissions made by the learned counsel for the petitioner that the co-accused have already been released on bail, since they have no previous cases. However, in the present case, the petitioner is having nine previous cases. Hence, this Court is not inclined to grant bail to the petitioner. 7.
