Ganapathi, No. 2/25A, Kakangarai Post, Tirupathur District. ..Petitioner(s) Vs State Rep by The Inspector of Police, Kandili Police Station, Kandili. Tirupathur District. Crime No. 56 of 2026 ..Respondent(s) Criminal Original Petition under Section 482 of BNSS, praying to enlarge the petitioner on anticipatory bail in the event of his arrest in Crime No.56 of 2026 on the file of the Respondent Police and condition may be applied as this Honorable Court. For Petitioner(s): No Appearance For Respondent(s): Mr.N.Palanivel, Govt.Advocate (Crl.Side) ****** https://www.mhc.tn.gov.in/judis CRL OP No. 21685 of 2026 __________ Page2 of 4 ORDER The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 326(a) of BNS and Section 21(1) of Mines and Minerals (Development and Regulation Act, 1957) in Crime No.56 of 2026, on the file of the respondent Police, seeks anticipatory bail. 2.There is no representation on behalf of the petitioner. 3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioner has got 7 previous cases. 4.From the submissions made by the learned Government Advocate (Criminal Side), it is seen that the petitioner has got previous cases against him, which clearly demonstrates that whenever he is granted anticipatory bail by the Courts, he misused the liberty granted to him. In view of the same, if the petitioner is enlarged on anticipatory bail, he may be emboldened to indulge in similar offences in the future without fear of the law. Hence, taking into consideration the interest of society at large, this Court is not inclined to enlarge the petitioner on anticipatory bail. 5.Accordingly, this Criminal Original Petition stands dismissed. 07-08-2026 KMI https://www.mhc.tn.gov.in/judis CRL OP No. 21685 of 2026 __________ Page3 of 4 To 1.The Inspector of Police, Elachipalayam Police Station, Namakkal District. 2.The Public Prosecutor Madras High Court. https://www.mhc.tn.gov.in/judis CRL OP No. 21685 of 2026 __________ Page4 of 4 C.KUMARAPPAN, J.
