THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER A Demand Draft in a sum of ₹60,000/- is tendered by the petitioner to the learned counsel for respondent. With the tendering of said demand draft, sum of ₹90,000/- said to have been paid by the petitioner to the respondent as ₹30,000 is in deposit before the trial Court. 2. Fine amount imposed by the trial Court is a sum of ₹1,20,000/- and ₹5,000/- is also imposed towards the defraying expense of the State. Amount is due from the year 2019 and therefore no concession can be shown. - 3 - HC-KAR NC: 2026:KHC:20059 CRL.RP No. 457 of 2023 However, learned counsel for the petitioner Sri. K. V. Satishchandra would submit that taking note of the financial condition of the petitioner, the fine amount be modified reasonably. 3. Since an amount of ₹90,000/- is already paid by the petitioner as against ₹1,20,000/-, petitioner is directed to pay another sum of ₹20,000/- on or before 20.05.2026. 4. A memo is filed in this regard on behalf of the petitioner. 5. Memo reads as under: “The petitioner most respectfully submits as follows: The petitioner submits that he undertakes to settle the entire amount on or before the next date of hearing. Hence, it is most respectfully pray that this Hon’ble Court may be pleased to take the memo on record in the interest of justice.” 6. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 8. It is made clear that balance amount of ₹20,000/- if not paid on or before 20.05.2026, petitioner shall undergo simple imprisonment for a period of two months.
