C.M.P.No.22578 of 2026 O R D E R (Order of the Court was made by G.Jayachandran J.) This application has been filed to condone the delay of 1245 days in representing the papers connected to Writ Appeal SR.No.112137 of 2023. The reason for delay, as stated in paragraph No.3, attributes to procedure established by the establishment for getting certified copy of the order, the legal advice of Counsel and the approval of the Ministry of Law and Justice. 2. The Learned Counsel appearing for the respondents submitted that the Industrial Dispute which arose in the year 1992 in I.D.Nos.62 and 63 of 1992 ended in favour of the respondent/workman vide award dated 03.04.2006. Being aggrieved, the Management preferred W.P.Nos.42419 & 42524 of 2006, which came to be dismissed on 15.06.2022. While so, the Management has preferred an appeal against the order passed by the Learned Single Judge in the cavalier manner on 25.08.2023 and did not care to rectify the defects pointed out by the Registry. Thus, the delay of 1245 days has crept in representing the appeal papers after curing the defects. 3. The Learned Counsel appearing for the respondents further submitted that even for filing Writ Appeal, the Management/Appellant had not been vigilant and preferred the appeal only after one year two months. C.M.P.No.22578 of 2026 the appeal with considerable delay, to rectify the defects pointed out by the Registry, the appellant has taken more than three years. As a result, the Workman, who was deprived of his lawful right agitating his cause since 1992, without seeing the colour of the coin, despite the award passed in his favour in the year 2006. 4.
On considering the narration of the facts put forth by the Learned Counsel for the respondents, we dismiss the condone delay application, since the reasons stated for the delay in representation does not correlate with the facts on record. 5. Accordingly, this Civil Miscellaneous Petition is dismissed. Consequently, the connected Writ Appeal stand rejected at the SR stage itself.
