Mr.S.Vinoth Kumar, learned counsel undertakes to enter appearance for the respondent, however, the learned counsel states that the respondent is employed in Ireland and he seeks two weeks time to file vakalat. 3. On going through the averments made in the transfer civil miscellaneous petition, I find that the petitioner/wife is a resident of Pudukottai district and she seeks transfer of HMOP.No.710 of 2024 filed by the respondent/husband from the file of the Subordinate Court, Alandur, Chengalpattu district to Family Court, Pudukottai. 4. Considering the fact that, admittedly, the respondent will not be in a position to attend the proceedings even before the Sub Court, Alandur, Chengalpattu district, of course, there the presence of the parties is not mandatory, since it is not a dedicated Family Court, I am inclined to allow the transfer civil miscellaneous petition with the following directions. a) HMOP.No.710 of 2024 is withdrawn from the file of the Sub Court, Alandur, Chengalpattu district and transferred to the file of the Family Court, Pudukottai https://www.mhc.tn.gov.in/judis TR CMP No. 660 of 2026 __________ Page3 of 4 b) The Family Court shall not insist on the physical presence of the respondent/husband on all hearing dates and the respondent shall be permitted to engage a counsel to represent him on regular hearing dates. However, the respondent shall appear in person or if permissible through video conferencing facility, if available on hearing dates when his examination will have to be recorded in chief and cross and not for all hearing dates. 5. Considering the fact that HMOP.No.710 of 2024 is pending for more than two years, I direct the Family Court, Pudukkottai to ensure completion of pleadings within a period of eight weeks and dispose of the HMOP.No.710 of 2024 within a period of nine months thereafter. 6. With the above observations/directions, the Transfer Civil Miscellaneous Petition is allowed. There shall be no order as to costs.
