W.P.No.33607 of 2026 __________ Page2 of 6 ORDER With the consent of both sides, this Writ Petition is taken up for final disposal at the stage of admission itself. 2. The relief sought in this Writ Petition is to direct the Respondents to permit the Petitioner to upload her Relationship Certificate and permit her to take part in the MBBS 2026-2027 Selection Process under the NRI category. 3. The learned counsel for the Petitioner submitted that Petitioner appeared for National Eligibility cum Entrance Test (UG) – 2026 Examination conducted by the National Testing Agency and secured 274 marks. At that time, Petitioner’s maternal uncle, an NRI residing at Singapore has come forward to financially sponsor her medical education. 3.1. It is further submitted by the learned counsel for the Petitioner that even before the declaration of NEET (UG) – 2026 Examination results, 2nd Respondent had invited Applications for the admission of MBBS/BDS course session 2026-2027. Therefore, Petitioner submitted an Application bearing Application No.26UG931574 for admission of MBBS course under NRI Quota. At the time of submission of documents, Petitioner had enclosed all the documents as stipulated in the prospectus except the Relationship Certificate as https://www.mhc.tn.gov.in/judis
W.P.No.33607 of 2026 __________ Page3 of 6 she was not able to obtain the same from the Revenue Authority. Since Petitioner failed to enclose the Relationship Certificate as stipulated in the prospectus, she was declared as an ineligible candidate under NRI Quota. 3.2.
The learned counsel for the Petitioner also submitted that considering the grievance of candidates who have been found ineligible for admission to the MBBS course on account of non-submission of the requisite documents, 2nd Respondent vide Notification dated 04.08.2026, extended the time for uploading the requisite documents till 07.08.2026. Pursuant to the issuance of said notification, on 06.08.2026, Petitioner approached the concerned Revenue Authority and obtained the Relationship Certificate as well as Ward Certificate. The Petitioner had obtained an endorsement of concerned Revenue Authority in Annexure – II of the Ward Certificate and upload the same, but, she did not upload the Relationship Certificate. 3.3. In the meantime, 2nd Respondent once again extended the time for uploading the requisite documents till 10.00 a.m. on 12.08.2026. Subsequently, the NRI Merit List for admission to the MBBS course was published on 13.08.2026, but, Petitioner’s name was not included in the said Merit List. Though Petitioner had obtained the Relationship Certificate from the Revenue Authority even prior to 12.08.2026, due to ignorance, she uploaded the Ward Certificate alone and she failed to upload the Relationship Certificate. https://www.mhc.tn.gov.in/judis

That apart, learned counsel for the Petitioner submitted that First Round of Counselling is in progress. The process of Choice Filling & Locking is available only till 5.00 p.m. on 19.08.2026 and the processing of seat allotment would be commenced on 20.08.2026. Therefore, the learned counsel prayed that Petitioner may be permitted to participate in the said First Round of Online Counselling currently being conducted by the Respondents. 4.
The learned Special Government Pleader appearing on behalf of the Respondents submitted that as per Clause 11 (xii) of the Prospectus for Admission to MBBS/BDS Degree Courses issued by the Respondents, the candidates who are claiming NRI seats should upload the Certificate of Relationship between the NRI Financial Supporter and the candidate issued by the competent Revenue Authority with valid Indian Passport of the NRI Financial supporter. In this case, Petitioner had uploaded the Ward Certificate (Annexure-II) alone and she did not upload the Relationship Certificate. Hence, Petitioner’s name was not included in the NRI Merit List for admission to the MBBS course. 5. Considering the above facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court directs the Respondents to permit the Petitioner to upload the Relationship Certificate through concerned online portal or submit it physically and also, permit her to participate in the First Round of Online Counselling currently being conducted by the Respondents. 7.
