P.P. …...... 03/20.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 103(1), 238, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. The husband of the informant was murdered. 4. Admittedly, petitioners are not named in the F.I.R. During investigation, the name of these petitioners came up, but admittedly there is no eye witness which suggest that the petitioners have committed the murder. The only material in the investigation is Call Detail Report of these petitioners and their tower location which was found to be near the spot where the incident had occurred. Further from the Call Detail Report it was found that they were taking with the deceased. 5. Considering the nature of evidence which has been gather during investigation and the fact that chargesheet has already been submitted and co-accused person has been granted bail on 01.12.2025 passed in B.A. No.10320 of 2025 by co-ordinate Bench of this Court, I am inclined to grant bail to these petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Pakur in connection with Pakur Town Police Station Case No.05 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand.
