The allegation against the petitioner is that the petitioner along with other accused persons were found in illegal possession of 1.300 kilograms of ganja, resulting in the registration of a case. 3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person. He further submitted that he has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent condition imposed by this court. Hence, he prays to grant anticipatory bail to the petitioner. 4. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution's case submitted that the petitioner/A4 is absconding the A1 to A3 were already arrested and remanded. The contraband recovered from them weighs about 1.300 kilograms of ganja. This petitioner has two previous cases pending against him out of which one is filed under Section 302 of IPC and investigation has not yet been completed and hence, he opposed the grant of anticipatory bail to the petitioner. 5. Considering the submissions of the learned Government Advocate (Crl. Side), and the other accused A1 to A3 were already arrested and this is a case involving recovery of 1.300 kgs of ganja and that the petitioner has two previous cases pending against him out of which one is filed under Section 302 of IPC which clearly demonstrates that if bail is granted, there is a likelihood of the petitioner misusing the liberty and thereby subverting the course of justice. Hence, this Court is of the view that the petitioner does not deserve the grant of bail. 7. Accordingly, this Criminal Original Petition is dismissed. 14-08-2026 GV To 1.
