This Writ Petition has been filed by the Petitioner praying to direct the 3rd Respondent to consider the Petitioner’s Representation dated 21.08.2025 and register the Sale Deed dated 18.02.2022 in respect of the land comprised in Survey No.42/2A measuring an extent of 1.20 Acres situated at Rangopanditha Agraharam Village, Hosur Taluk, Krishnagiri District (hereinafter referred to as “subject lands”) presented by the Petitioner, within a time frame to be fixed by this Court. 3. The case of the Petitioner is that his Principal viz., Mr.C.Manjunatha had purchased the subject lands from one Mr.P.Murugesan vide Sale Deed dated 02.07.2014 which was registered as Document No.9257 of 2014 on the file of 3rd Respondent. From the date of purchase, Petitioner’s Principal has been in peaceful possession and enjoyment of the subject lands. https://www.mhc.tn.gov.in/judis W.P.No.24089 of 2026 __________ Page3 of 6 4. The Petitioner’s Principal had executed a Power of Attorney dated 22.01.2015 in favour of one Mr.S.Suresh in respect of the subject lands. Due to some financial crises, Petitioner’s Principal proposed to sell the subject lands to one Mr.Claurance & his partners vide Sale Deed dated 18.02.2022. On behalf of the Petitioner’s Principal, Petitioner presented the said Sale Deed for registration before the 3rd Respondent. However, 3rd Respondent has refused to register the same for the following reasons: (i) Without any valid title, two persons viz., Natarajan and Arunachalam sold the lands to 3rd parties. The Commissioner (Land Reforms) declared that the said sale transactions are void and inoperative. (iii) Subsequently, vide Allotment Order dated 28.02.1979, Patta was transferred in favour of one Mr.Ellappan. 5. Subsequently, 1st Respondent vide Proceedings dated 24.04.2023 bearing Pa.Mu.22859/2022/J2, directed the Revenue Authority to remove the names of aforesaid Natarajan & Arunachalam from “A” Register and to include the names of Mr.Ellappan & Kannammal in “A” Register. The Petitioner made a Representation dated 21.08.2025 before the 3rd Respondent, requesting to register the Sale Deed dated 18.02.2022 presented by him. Thereafter, 3rd Respondent sent a Communication dated 20.08.2025 to the 1st Respondent, wherein, 3rd Respondent had narrated the above things and sought clarification from the 1st Respondent as to whether the Sale Deed dated 18.02.2022 presented https://www.mhc.tn.gov.in/judis W.P.No.24089 of 2026 __________ Page4 of 6 by the Petitioner can be accepted for registration. Though Petitioner is ready and willing to submit all the relevant documents for registration of Sale Deed dated 18.02.2022, 3rd Respondent refused to register the said Sale Deed by stating the reason that Communication dated 20.08.2025 addressed to the 1st Respondent is still pending consideration before the 1st Respondent. Hence, left with no other alternative, Petitioner has filed this Writ Petition for the relief stated supra. 6. The learned Additional Government Pleader appearing on behalf of the Respondents 2 & 3 submitted that so far, Petitioner has not made any Representation dated 21.08.2025 before the 3rd Respondent. She further submitted that if Petitioner submits any representation before the 3rd Respondent seeking to register the Sale Deed dated 18.02.2022, 3rd Respondent would consider the same in accordance with law. 7. In view of the above submissions made by the learned Additional Government Pleader, this Court issues the following directions: (i) The Petitioner is directed to submit a fresh Representation before the 3rd Respondent seeking to register the Sale Deed dated 18.02.2022. (ii) If any such representation is submitted by the Petitioner, 3rd Respondent shall consider the same in accordance with law and register the Sale Deed dated 18.02.2022, if it is otherwise in order, forthwith. https://www.mhc.tn.gov.in/judis W.P.No.24089 of 2026 __________ Page5 of 6 (iii) If for any reason, registration of the Sale Deed is sought to be refused, 3rd Respondent shall issue a Refusal Check Slip/Order assigning appropriate reasons. 8.
