Petitioners have filed this writ petition seeking following reliefs:- “10.1. That, this Hon’ble Court may kindly be pleased to issue a writ, order, or direction in the nature of Mandamus, directing the Respondents authority to grant/provide the benefit of the Revised Pay Scale to the petitioners after completion of 3 years of service, as per the policy and in view of the affidavit submitted by the Respondent State Authority in W.A. No. 481/2015. 10.2That, this Hon'ble Court may kindly be pleased to direct the Respondents Authority to calculate and pay the entire arrears of salary and other consequential benefits (including Dearness Allowance) arising from the revision of pay scale, from the date of entitlement to the date of actual payment. 10.3That, this Hon'ble Court may kindly be pleased to issue direct the Respondents Authority to pay interest at the rate of 12% per annum on the total amount of arrears due to the petitioners, calculated from the date they became eligible until the date of actual realization. 10.4That, this Hon'ble Court may kindly be pleased to pass any appropriate orders/ directions in favour of the petitioners looking to the facts and circumstances of the case.” 2. Learned counsel for the petitioner submit that the petitioners were appointed as Work-charged Contingency Paid Class IV employees. The description of appointment, date of joining and date of completion of 3 years is mentioned in the chart 5 annexed below. He contended that pursuant to the order passed by High Court in WA. No. 481/2015 (Prakash Dansena & Ors. Vs. State of Chhattisgarh & Ors.) dated 03.10.2018, the respondent authorities have granted time bound pay scale to the similarly situated employees vide order dated 20.09.2021. Though the petitioners are also getting the benefits of the revised pay scale, however, they have not been given the arrears of the revised pay scale since the date when the petitioners were became entitle for the revised pay scale. He submits that petitioners at this stage may be permitted to submit a representation before the respondent No.5 and the concerned respondent may be directed to consider and to take decision at the earliest within a specific time frame. 3. Learned counsel for the State submits that as petitioners are not pressing this petition on merits and is only seeking the permission to submit representations to be decided by respondent No.5, he is having no objection to the limited prayer. 4. I have heard learned counsel for the respective parties and perused the documents placed on record. 5. On due consideration on the submission of learned counsel for the respective parties, facts and circumstances of the case, the nature of grievance raised in this writ petition, without entering into the merits of the claim of the petitioners this writ petition at 6 this stage is disposed of permitting petitioners to submit fresh comprehensive representation along with all supporting documents before respondent No.5 and if such representations are submitted, the respondent No.5 shall consider and take decision on the same in accordance with law expeditiously preferably within further period of 04 months from the date of receipt of representation.
