Respondent(s) Prayer: This Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents, to consider the representation of the Petitioners dated 04.08.2026 and allot the newly constructed Municipal shops to the eligible erstwhile occupants/lessees of the old Municipal shops in the light of G.O.(2D) No.66, Municipal Administration and Water Supply (Municipal Administration-4) Department, dated 06.08.2024, consequently forbear the respondents from in any manner proceeding with E-Auction dated 21.08.2026 or allot the newly constructed Municipal shops to any third party or create any third-party rights, pending consideration and disposal of the Petitioners’ claim. The petitioners are before this Court seeking a direction to the respondent to consider their representation dated 04.08.2026 and allot the newly constructed municipal shops to the eligible erstwhile occupants/lessees of the old municipal shops, in terms of G.O.(2D).No.66, Municipal Administration and Water Supply (Municipal Administration-4) Department, dated 06.08.2024. They also seek a direction to forbear the respondents from proceeding with the e-auction scheduled on 21.08.2026. 3. The petitioners state that they were lessees of shops belonging to the respondent Corporation and that, during the subsistence of their lease, possession of the shops was taken for construction of a new market complex. According to the petitioners, they were assured that shops in the newly constructed market complex would be allotted to them. They further state that the new market complex has now been completed, but the respondent has issued the e-auction notice dated 21.08.2026, thereby depriving them of their claim for allotment of shops. 4/7 https://www.mhc.tn.gov.in/judis W.P.No.33931 of 2026 4. The learned counsel for the respondent submitted that the aforesaid Government Order has been set aside by this Court. He further submitted that the petitioners may make an application under Rule 316(11)(a) of the Tamil Nadu Urban Local Bodies Rules, 2023. The said provision enables the Council, in the case of demolition and reconstruction, to give preference to the existing licensees of the demolished shopping complex, provided they match the highest bid and produce the necessary documents to establish their eligibility. He further submitted that the petitioners’ application would be considered subject to payment of any arrears of rent. 5. Recording the above submission, this Writ Petition is disposed of, granting liberty to the petitioners to submit an application under Rule 316(11)(a) of the Tamil Nadu Urban Local Bodies Rules, 2023. If such an application is submitted, the respondent shall consider the same in accordance with the said Rules. There shall be no order as to costs.
