Mr. Pradeep Lohani, learned AGA, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Kulwant Singh, who has been accused in Case Crime/FIR No.416 of 2025, under Sections 109 (1), 115 (2), 191 (2), 191 (3), 351 (2) of BNS and under Sections 3/25 of the Arms Act, at Police Station Bazpur, District Udham Singh Nagar. 4. As per the case of the prosecution that an FIR was lodged by one Gurcharan Singh, with the averments that there is a dispute of land and water between the parties and during the altercation, the Applicant assaulted with a lathi and illegal weapons, and the Complainant and other persons were injured. 5. Learned counsel appearing on behalf of the Applicant submits that the Applicant has been falsely implicated in the present matter. He further submits that the Applicant has no previous criminal history and the Applicant has been languishing in jail since 30.11.2025. 6. Learned State Counsel has vehemently opposed the bail application of the Applicant. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed. It is directed that the Applicant - Kulwant Singh, who has been accused in Case Crime/FIR No.416 of 2025, under Sections 109 (1), 115 (2), 191 (2), 191 (3), 351 (2) of BNS and under Sections 3/25 of the Arms Act, at Police Station Bazpur, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
