The first bail application filed on behalf of the accused-applicants has been dismissed as withdrawn with liberty to file afresh after submission of charge-sheet, vide order dated 16.12.2025 by this Court passed in S.B. Criminal Miscellaneous [2026:RJ-JP:13000] (2 of 4) [CRLMB-968/2026] Bail Application No.15632/2025 and S.B. Criminal Miscellaneous Bail Application No.15562/2025, respectively. 2. This second bail application has been filed by the accused-applicants under Section 483 of B.N.S.S., 2023 in connection with FIR No.220/2025, registered at Police Station Manak Chowk, Jaipur City (North) for the offences punishable under Section 109(1), 311, 331(6) of B.N.S., 2023 and under Section 4/25 of Arms Act, 1959. 3. Learned counsel for the accused-applicants submit that the accused-applicants have falsely been implicated in this case. Learned counsel also submit that charge-sheet in this matter has been filed for the offences punishable under Sections 109(1), 311, 331(6) and 3(5) of B.N.S., 2023 and under Section 4/25 of Arms Act, 1959 has already been filed. Copy of the charge-sheet has been submitted which is taken on record. Learned counsel for the accused-applicants submit that the allegation against the accused- applicants is that both have attempted to commit robbery of jewellery from the possession of the complainant. In the course of committing the robbery, allegedly, they inflicted sharp-edged injury to one Anuj Kumar and Om Prakash. Learned counsel further submit that the injury caused to the aforesaid injured persons is on their hand and not on the vital part of the body which has been found to be simple in nature. 4. Learned counsel for the accused-applicants submit that charge-sheet has been filed. Learned counsel also submit that accused-applicant namely Ayaaj Ahmad was arrested on [2026:RJ-JP:13000] (3 of 4) [CRLMB-968/2026] 01.10.2025 and accused-applicant namely Afsar Shekh @ Adha Kilo was arrested on 03.10.2025 and since then, they are behind the bars and trial is likely to take long time to conclude, therefore, the accused-applicants be granted benefit of bail. 5. Learned counsel appearing on behalf of the State vehemently opposes this bail application. 6. Heard learned counsel for the parties and also perused the material available on record. 7. Looking to the overall facts and circumstances of the case and the fact that 18 other cases have also been registered against accused Afsar Shekh, out of which, in 10 of the said cases, he has been acquitted; charge-sheet has already been filed and the trial is likely to take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow this second bail application filed by the accused- applicants. 8. Consequently, this second bail application filed under Section 483 of the B.N.S.S., 2023 is allowed. It is ordered that accused-applicants Afsar Shekh @ Adha Kilo S/o Ashfak Shekh & Ayaaj Ahmad S/o Riyaz Ahmad, arrested in connection with FIR No.220/2025, registered at Police Station Manak Chowk, Jaipur City (North) shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.1,00,000/- each and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the trial Court.
