ORAL ORDER
On the previous date of hearing, the following order was passed:
“Learned Additional Government Advocate takes notice for all the respondents.

Learned counsel for the petitioner is directed to serve copies of the petition along with annexures on the learned Additional Government Advocate.
Learned counsel for the petitioner submits that Annexure-C is the latest RTC of the year 2025-26, reflecting the name of the petitioner along with his other siblings, commencing from Yellamma as the owner in occupation of 1 acre 10 guntas in Survey No.107 of Doddathoguru Village, Beguru Hobli, Bangalore South Taluk. That being the position, without any notice, a board has been put up at the entrance of the property, as can be seen from the photographs at Annexure-A, stating that the land belongs to the government and no one should enter the property. Learned counsel submits that after this writ petition was filed, a notice was issued to the petitioner on 18.01.2026, calling upon the petitioner and others to explain why action should not be taken against them for eviction. On the face of it, since it is clear from the RTC that 1 acre 10 guntas belongs to the petitioner's family, the Deputy Commissioner could not have directed to install such a board in the

property belonging to the petitioner without passing necessary orders in accordance with law. In that view of the matter, respondent No.2- Deputy Commissioner, Bangalore South Taluk, is hereby directed to ensure that the board put up on the property belonging to the petitioner is removed forthwith and reported to this Court. Re-list this matter on 11.02.2026. By the next date of hearing, the petitioner along with his family members are required to give a reply to the notice issued by respondent No.4- Tahsildar, Bangalore South Taluk.”
2. Today, the learned Counsel for the petitioner submits that the Board has been removed this morning. However, learned Counsel submits that a direction may be issued to the respondent-Tahsildar, Bengaluru South Taluk, not to disturb the possession of the petitioner without following due process of law.
3. Having regard to the facts narrated hereinabove, the writ petition stands disposed of, with a clear direction to the respondent-Tahsildar, Bengaluru South Taluk, not

to cause any disturbance to the peaceful possession of the lands in question at the hands of the petitioner and his family members without due process of law.
Ordered accordingly.
