1. The applicant Deepak Kumar Chandrakar was charged under Section 138 of the Negotiable Instruments Act BHOLA NATH KHATAI Digitally signed by BHOLA NATH KHATAI Date: 2026.04.15 10:57:57 +0530
2 regarding the dishonour of Cheques No. 064426 & 064427 amounting a total of Rs.36,13,400.

The trial Court i.e. JMFC, Mahasamund vide judgment dated 19.12.2019 in Complaint Case No. 1998/2016 convicted the applicant for the offence punishable under Section 138 of Negotiable Instruments (NI) Act and sentenced him to undergo Rigorous Imprisonment for 6 months and pay fine/compensation of Rs.40,00,000/- with interest of 9% from the date of judgment till its realization.

In appeal i.e. Criminal Appeal No.H-05/2020 preferred by the applicant, the Sessions Judge, Mahasamund (C.G.), vide impugned judgment dated 27.04.2023, modified the sentence of 6 months RI till rising of the Court, however, upheld the compensation of Rs.40,00,000 and directed to deposit the same within a period of 60 days, failing which to undergo the sentence imposed by the trial Court, against which the present revision has been filed.
4. At the request of both the parties, the matter was referred to the Mediation Centre of this Court for an amicable settlement. As per the settlement report dated 12.02.2026 received from the mediation Centre, applicant Deepak Kumar Chandrakar, has paid a sum of 10,00,000/- ₹
(Rupees Ten Lakhs) to the complainant, Rakesh Kumar Chandrakar, in two installments via RTGS this morning,
3 within the stipulated two-month period. An amount of Rs.20,00,000/- (twenty lakhs) had already been deposited in the trial Court earlier.

Learned counsel for the complainant acknowledges the receipt of the said amount and submits that no further dues remain outstanding against the applicant.
6. In view of this settlement between both parties, applicant Deepak Kumar Chandrakar is acquitted of the charge under Section 138 of N.I. Act.
7. Accordingly, the criminal revision is disposed of. The bail bonds and sureties of the applicant shall stand discharged.
8. Record of the trial Court along with the copy of this order be sent forthwith for compliance and necessary action, if any. Sd/- (Sanjay Kumar Jaiswal)
