Petitioners are serving as daily wage employees in Garhwal Mandal Vikas Nigam Limited for more than 17 years. 3. According to petitioners, work performed by them is perennial in nature and sufficient number of sanctioned posts is also available for regularising their services; however, their claim for regularisation is not being considered. 4. Another grievance raised by petitioners is regarding minimum of pay scale, as is payable to regular employees. 5. Since petitioners have served for more than 17 years, therefore they have certainly earned a right to be considered for regularisation, if rules so permit. 6. Petitioners have relied upon the law declared by Hon’ble Supreme Court in Civil Appeal No. 213 of 2013, State of Punjab and others Vs. Jagjit Singh & others, for claiming minimum of pay scale. 2026:UHC:4174 7. Learned counsel appearing for Garhwal Mandal Vikas Nigam Limited, however, submits that petitioners were engaged as per exigencies of work in the absence of any sanctioned post. He, however, submits that grievance, if any, should be highlighted by petitioners before the competent authority in Garhwal Mandal Vikas Nigam Limited. 8. The writ petition is, accordingly, disposed of by permitting petitioners to make representation claiming regularisation as well as minimum of pay scale. If petitioners make such representation within two weeks, Managing Director of Garhwal Mandal Vikas Nigam Limited, shall look into the issues raised by petitioners and take appropriate decision by passing a reasoned order within ten weeks from date of receipt of certified copy of this order.
