1. Heard Mr. Kalantri, learned Advocate for Applicant and Mr. Karmakar, learned APP for State.
2. This is an Application under Section 439 of the Code of Criminal Procedure, 1973 and Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Bail in connection with CR No. 348/2019 registered with Sarkar Wada Police Station for the offences punishable under Sections 420, 465, 468, 471 r/w 34 of the Indian Penal Code, 1860 (for short "IPC").
3. On 2nd September, 2026, after hearing the learned Advocates appearing for the respective parties, the following order was passed:-

2. Mr. Kalantri, learned Advocate persuades me to consider Exhibit ‘B’ – page No.83 of the Application. The settlement certificate dated 15.07.2026 issued by the Union Bank of India, Nashik City Branch, inter alia, with regard to the entire Non Performing Asset (NPA) account having been repaid and closed in one time settlement granted by the Bank to the Applicant.
3. I direct the Applicant to present the said settlement certificate to the Court to enable the Court to consider his case for grant of bail.
4. In the meanwhile, issue notice to Respondents namely Bank.
5. Copy of this order shall be served forthwith on the Bank and the Bank is directed to appear before this Court tomorrow at 03:00 p.m. through responsible officer to intimate the Court about the certificate in question.
6. Prosecution shall express instructions from the Investigating Officer only to the veracity of the said certificate at Exhibit ‘B’ and inform the Court accordingly on the next date i.e. tomorrow.
7. Stand over to 3rd September 2026 at 03:00 p.m.."
4. Carrying on further, the bank officers are present online and they confirm the directions contained in paragraph No. 2 of the aforesaid order. The settlement certificate referred to in the aforesaid
order is shown to me. After perusing the same, the original thereof is returned to the learned Advocate for the Applicant.
5. In view of the above, the Applicant has made out a case for grant of bail. Hence, the Applicant is granted bail on the following conditions: (i) Applicant is directed to be immediately released from prison in connection with CR No. 348/2019; (ii) Applicant is directed to be released on bail on furnishing P.R. Bond of Rs. 25,000/- (Rs. Twenty Five only) with one or two sureties in the like amount; 2 of 4

BA-3351-26.odt (iii) Applicant shall report to the Investigating Officer at Sarkar Wada Police Station, once every month on the first Sunday of the month between 10:00 a.m. to 12:00 p.m.; (iv) Applicant shall co-operate with the conduct of trial and attend the Trial Court on all dates, unless specifically exempted and will not take any unnecessary adjournments, if he does so it will entitle the prosecution to apply for revocation of this order; (v) Applicant shall not leave the State of Maharashtra without prior permission of the Trial Court; (vi) Applicant shall not influence with any of the witnesses or tamper with the evidence in any manner; (vii) Applicant shall keep the Investigating Officer informed of his current address and mobile contact number and / or change of residence or mobile details, if any, from time to time, as applicable; and (viii)Any infraction of the conditions shall entail cancellation of bail granted to the Applicant.
6. Needless to state that the above observations will not come in the way of trial as they are prima facie in nature based on the
submissions made and the material placed before this Court. 3 of 4
