Umakanta, senior advocate is before this Court. [3] Captioned MC has been filed with a CoD prayer qua a statutory appeal under Section 21 of NIA Act. [4] In the captioned MC, delay of 67 (sixty seven) days has been sought to be condoned qua an appeal against an order dated 07.03.2026 made by learned Special Judge, NIA Special Court-I, Manipur in Cril.Misc.Case No. 1104 of 2025 wherein and whereby an application made by appellant with a prayer to treat him as CCL has been rejected. To be noted, this 07.03.2026 order is being referred to as ‘impugned order’. [5] Captioned MC has been filed on the basis that the Criminal Appeal has been filed on 15.06.2026 but case file shows that it has been filed only on 24.06.2026 at 14:16:48 P.M. vide filing No. Crl.A./254/2026, E- filing No. AMN20250000322C202600024 and CNR : MNHC010016292026. Scanned reproduction of the acknowledgement slip is as follows : [6] Besides this, there appears to be an error in computation as, on a demurer/hypothetically, even if the appeal had been filed on 15.06.2026, there is delay of 96 (ninety six) days and not 67 (sixty seven) days. [7] Faced with the above situation, learned counsel on record for MC applicant sought leave of this Court to withdraw the captioned MC but made a further prayer to preserve all the rights and contentions of MC applicant to come up with another suitable application / CoD application after making requisite course correction/s. [8] In this regard, Ms. Kathamlu Riamei, learned counsel on record for applicant has made an endorsement in the case file and scanned reproduction of the same is as follows : [9] If MC applicant chooses to file another application/CoD application, this order shall be enclosed as an Annexure and though obvious, it is made clear that such MC application shall be dealt with on its own merits and in accordance with law. [10] Captioned MC disposed of as withdrawn/closed albeit with preservation of rights as set out supra and abbreviation as above. There shall be no order as to costs.
