Amarnath Counsel for Government of Tamil Nadu (Criminal Side) ORDER This Criminal Miscellaneous Petition has been filed to suspend the sentence imposed on the petitioner pursuant to the judgment dated 29.04.2026 passed in Crl.A.No.2 of 2026 on the file of the learned II Additional District Sessions Judge, Arakkonam, Ranipet District confirming the judgment dated 21.11.2025 passed in C.C. No.9 of 2023 on the file of the learned Judicial Magistrate, Sholinghur, pending disposal of the above criminal revision. 2. The petitioner has been convicted and sentenced by the learned Trial Judge as follows:- Conviction under Section Sentence awarded 454 IPC To undergo three years of Simple Imprisonment and to pay a fine of Rs.5,000/-, in default of payment of fine, to undergo Simple Imprisonment for a further period of six months 380 IPC To undergo three years of Simple Imprisonemnt and to pay a fine of Rs.5,000/-, in default Simple Imprisonment for a further period of six months. https://www.mhc.tn.gov.in/judis CRL MP No. 15513 of 2026 __________ Page3 of 5 3. Aggrieved by the same, the petitioner filed a Criminal Appeal in Crl.A.No.2 of 2026 and the same was dismissed by the learned II Additional District and Sessions Judge, Arakkonam, Ranipet District, confirming the judgment dated 21.11.2025 passed in C.C. No.9 of 2023 on the file of the Judicial Magistrate Court, Sholinghur, Ranipet District. Aggrieved by the same, the petitioner has filed the present Criminal Revision Case before this Court along with the instant criminal miscellaneous petition seeking suspension of sentence and bail. 4. Learned counsel for the petitioner submits that in the respondent’s house, their jewels found missing and therefore, they gave a complaint against the petitioner. It is his contention that without any basis, allegations were levelled against the petitioner. He further contended that in the final report submitted by the prosecution, the offence under Section 380 of IPC alone stated. However, the trial Court passed conviction against the petitioner for the offences under Sections 380 and 454 of IPC, which is an erroneous one. Therefore, he prayed for suspending the sentence imposed on the petitioner and to grant bail. 5. Considering the fact that there are substantial grounds raised in the above revision, which require consideration, this Court is inclined to grant the relief of suspension of sentence to the petitioner on the following conditions : (i)The petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court, Sholinghur, Ranipet District; (ii)The petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity; (iii) The realization of fine amount, if any, shall also remain suspended during the pendency of the present Revision. (iv)On failure of the aforesaid conditions, it is open to the Trial Court to commit the petitioner/accused into custody for undergoing the sentence. 7.
