For Petitioner(s): Ms.G.Ambika For Respondent(s): Mr.B.Karthikeyan Additional Government Pleader for R1 and R2 Mr.Durai Gunasekaran Government Advocate (Crl.Side) for R3 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus to consider the petitioner’s online application dated 16.06.2026. 2. The case of the petitioner is that the petitioner has purchased a property measuring to an extent of 0.67 cents of land comprised in Survey No.10/1, situated at Vellalapuram Village, Edapadi Taluk, Salem District, vide Sale Deed No.3993 of 2025 dated 30.06.2025 on the file of the Sub Registrar, Jalakandapuram, Salem District. Subsequently, the said property was sub- divided as Survey No.10/1B and Patta No.4727 was also issued in favour of the __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP No. 31218 of 2026 petitioner. Since there is a doubt regarding the boundary of his property, he made a representation dated 16.06.2026 seeking to survey his land and fix boundary stones. However, the same has not been considered till date. Hence, the present Writ Petition has been filed. 3. In response, Mr. B. Karthikeyan, learned Additional Government Pleader appearing for respondents 1 and 2, submitted that based on the petitioner’s online application dated 16.06.2026, the date of survey is scheduled for 14.08.2026. 4. Considering the facts and circumstances of the case and the submissions made on either side that the date of survey is already fixed for 14.08.2026, this Court directs respondents 1 and 2 to complete the survey of the land comprised in Survey No.10/1B, situated at Vellalapuram Village, Edapadi Taluk, Salem District, and fix boundary stones on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the 3rd respondent Police, and the 3rd respondent Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WP No. 31218 of 2026 can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 5. With the above directions, this Writ Petition stands disposed of.
