For Petitioner : Mr.S.Madhusudanan for Mr.Harris Alfred ***** ORDER This civil revision petition has been filed under Article 227 of the Constitution of India against the order dated 10.12.2025 passed by the learned IV Assistant Judge, City Civil Court, Chennai, in I.A.No.8 of 2025 in https://www.mhc.tn.gov.in/judis CRP No.4878 of 2026 __________ Page2 of 4 O.S.No.1727 of 2024, wherein the Court below dealt with an application filed by the petitioner/third defendant under Order IX Rule 7 CPC and allowed the application by imposing cost of Rs.500/-. The condition imposed by the Court below has been put to challenge in the present revision. 2. Heard learned counsel for petitioner and carefully perused the materials available on record. This Court also went through the impugned order. 3. In the considered view of this Court, the condition imposed by the Court below is very reasonable and the same does not require the interference of this Court. However, it is seen that the order was passed on 10.12.2025 and this revision has been filed on 01.07.2026 only to get over the condition imposed by the Court below. In view of the same, this Court is inclined to enhance the cost imposed by the Court below to Rs.3,500/- [Rupees Three Thousand and Five Hundred only] payable by the petitioner to first respondent/plaintiff within a period of one (1) week from today. If this condition is complied with, the order passed by the Court below shall stand confirmed.
