GP FOR HIGHER EDUCATION The Court made the following Order: Heard Sri Vijay Mathukumilli, learned counsel for the petitioner and the learned Government Pleader for Higher Education appearing for the respondents. 2. The impugned proceedings were passed on the ground that the petitioner had failed to remit the affiliation fee. Secondly, on the ground that during the preceding academic year 2025-26 there remained substantial vacancies as far as the subject courses, namely Artificial Intelligence and Machine Learning, are concerned. 3. Learned counsel for the petitioner submits that, the impugned order was passed on an assumption that there is no demand for the subject course during the current academic year at Government Polytechnic College, Kalyandurg, Ananthapur District, which is wholly an unjustifiable reason as in the entire Ananthapur district, there is only one government institution offering AI and ML courses, and in the first phase of the counseling all the convener seats including EWSs seats of 33 in the Artificial Intelligence and Machine Learning course have already been filled and the petitioner institution is located at a distance of nearly 120 km away from the said government college at Kalyandurgam. It is further stated that in the entire District, no other private 4 institution offers the said course except the petitioner. Therefore, the said reasoning of the 1st respondent which is based on a previous year’s seat filling rate cannot become a criterion deciding the admissions of the present year. 4. The impugned order is passed based on the previous year’s data, even assuming the said is relevant for the fixation of the number of seats for the current academic year, however in the facts of the case the impugned order has been passed pursuant to the directions of this court, after the counseling had commenced, therefore the current data as appearing in the web portal constitute a valid data in the facts of the case, for deciding the petitioner’s prayer for granting of approval for admission of the students to the subject course(s) namely Artificial Intelligence and the Machine learning. 5. In view of the foregoing, the impugned proceedings are set aside. The respondent No.1 is directed to grant approval for the subject course(s) Artificial Intelligence And Machine Learning (DAIM) and permit the petitioner to participate in the ongoing counseling process and admit the students for the subject course(s). 6. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
