Mr. Lutful Haque Ms. Taharima Khatun Mr. Golam Karim Chowdhury ….for the petitioner Mr. Ayan Banerjee Ms. Sharmila Deb ….for the State Mr. Timir Baran Saha Mr. Prabir Majumder ….for the respondent Nos.8 & 9 On the prayer of the learned advocate for the petitioner leave is granted to the learned advocate on record of the petitioner to add the Sub Divisional Officer, Krishnagar Sadar as a party respondent in this writ petition and to amend the cause title of the writ petition, here and now. Since the State is represented by Mr. Banerjee, there is no necessity to serve a copy of this writ petition upon the added/respondent. However, the learned advocate on record of the petitioner shall be obliged to serve a copy of the amended cause title of the writ petition upon the learned advocate for the respondents forthwith. Affidavit of service filed in Court today is taken on record. 2 The petitioner claims to be the owner of Plot No.14 under Khatian No.1197, J.L. No.100 within Mouza- Kamarpara under Police Station- Bhimpur in the District of Nadia. The petitioner alleges that the private respondents have raised a construction upon the Government land thereby obstructing ingress and egress of the petitioner from his property to the main road. The allegations made by the petitioner in the writ petition is disputed by the private respondents. The learned advocate appearing for the petitioner submits that in spite of representation being made to the Sub Divisional Officer, Krishnagar Sadar by a letter dated January 20, 2026, no steps have been taken pursuant to the said request. Mr. Banerjee, learned advocate appearing for the State submits that the decision on the representation shall be communicated to the petitioner and any other parties within the time limit that may be fixed by this Court. In the light of the submission made by the learned advocates for the respective parties and without entering into the merits of the claim made by the petitioner in the representation dated January 20, 2026, WPA 2459 of 2026 stands disposed of by directing the Sub Divisional Officer, Krishnagar Sadar, being the added respondent to consider the representation of the petitioner dated January 20, 2026 and to dispose of the same by passing a reasoned 3 order after giving an opportunity of hearing to the petitioner, private respondents and any other persons, who may be affected by such decision and to communicate the reasoned order to the parties immediately thereafter. The entire exercise shall be completed as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order together with a copy of the representation dated January 20, 2026. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
