Order 10/04/2026
1. Apprehending his arrest in connection with FIR No.79/2025 registered at Police Station-Pachewar, District-Tonk for the offences under Section 308(2) of BNS, 2023, the petitioner has preferred this bail application under Section 482 BNSS.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The petitioner is a reporter who runs campaigns against quack doctors. The complainant Budhparkash dissatisfied with the petitioner's actions and having fabricated false evidence lodged a false report on concocted grounds. It is submitted that though there is an allegation against the present petitioner that he extorted
[2026:RJ-JP:15112] (2 of 3) [CRLMB-15716/2025] Rs. 15,000/- from the complainant but it is evident from the record that the said amount has been returned by the petitioner to the Ramdayal with an endorsement stating that "I am returning the money to you" and a screenshot was also sent on the same number. This shows false involvement in the present case. No custodial interrogation is required and petitioner is ready to join and co-operate with the investigation. Hence, the anticipatory bail of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. Considering the nature of allegations and the fact that the petitioner is ready and willing to co-operate with the investigation of the case but without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the bail application of the petitioner.
6. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner-Ramprasad S/o Shri Bannalal, he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and
