[2026:JHHC:10671] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.2235 of 2026 ------ Abhay Gope, Aged about 36 years, Son of Vishu Gope, R/o- House No.02, New Kapali Basti, Sonari, P.O. & P.S. – Sonari, Town Jamshedpur, District- East Singhbhum, Jharkhand .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Arun Kr. Pandey, Advocate For the State : Mr. Rajneesh Vardhan, Addl.P.P ------ Order No.03 Dated-15-04-2026 Heard the parties. The petitioner has been made accused in connection with Sonari P.S. Case No.147 of 2025 registered under Section 115 (2), 117 (2), 118 (1), 118 (2), 109, 352, 3 (5) of the B.N.S, 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was abusing someone in filthy language in a market place, when the informant along with his children were in a barber shop. As the informant requested the petitioner not to abuse in filthy language in presence of children, the petitioner called 3-4 of his friends and he attempted to murder the informant and after getting the information when the brother of the informant came and enquired from the petitioner as to why they have assaulted the informant, the petitioner attacked the brother of the informant namely Sandip Prasad on his head with a Chopper (heavy sharp cutting weapon) and the co-accused persons assaulted the victims with iron roads and hockey stick. It is submitted that the allegation against the petitioner is false. It is further submitted that the co-accused namely Nand Kumar Gope @ Nandu Gope who only assaulted the informant on his leg with a hockey stick, has already been given the privileges of anticipatory bail by a co-ordinate Bench of this Court vide order dated 19.02.2026 passed in A.B.A.952 of 2025. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view the fact that the petitioner is a ‘liquor Maafia’ and he intimidated the informant to leave Sonari Area of Jamshedpur as well as the fact that he is also involved in nine other cases, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is, therefore, submitted that the petitioner ought not be released on bail at this stage. Considering the serious nature of allegation against the petitioner, his criminal antecedent as well as his chance of absconding and tampering with the evidence, if released on bail, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage. (Anil Kumar Choudhary, J.) Dated-15.04.2026-Animesh/
