WP No.32739 of 2026 ORDER (Order of the Court was made by G.Arul Murugan, J.) This writ petition is filed seeking for a mandamus to direct the respondents to upload the petitioner's renewal application dated 09.11.2025 which was refused by the first respondent by order dated
08.12.2025. 2. It is the case of the petitioner that he has put up a dyeing unit under the name and style of “M/s.Deepthy Dyeing” in the subject property in Tiruppur North Taluk, Tiruppur District. Since the consent to operate the unit got expired, the petitioner has applied for renewal of the consent. When applying for renewal, the petitioner has sought for consent for the land in T.S.No.100. 3. The Tamil Nadu Pollution Control Board, upon processing the application filed by the petitioner, passed the order dated 08.12.2025 inter alia stating as follows:
“In this connection, it is found that the land on which your industrial unit, M/s.Deepthi Dyeing, is situated belongs to Arulmigu Visveswaraswami Temple, Tiruppur Town, and stands jointly registered in the names of Tmt.Balamani (wife), https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis
WP No.32739 of 2026 Tmt.Vijayalakshmi (daughter), Thiru K.Loganathan and Thiru.Kumaresh (sons), being the legal heirs of Thiru Krishnasamy Gounder, and Thiru Venkatasala Gounder, Officer of Arulmigu Visveswaraswami Temple. Further, you are requested to submit to this office the land subdivision records pertaining to Survey No.100 situated at Alangadu, Karuvampalayam, Tiruppur South Taluk, Tiruppur District, as subdivided through the Assistant Director of Survey and Land Records, Tiruppur.
It is further informed that, if an online application is submitted to the board for renewal of Consent and for operation of your industrial unit, the same will be considered in accordance with the applicable procedure.”

From the said communication, it is clear that the land in which the petitioner sought for consent in T.S.No.100 belongs to Arulmigu Visveswaraswami Temple, Tiruppur Town and it also stands jointly in the name of certain other individuals. The Board had requested the petitioner to get the land subdivision records from the Assistant Director of Survey and Land Records, Tiruppur and to make proper application through online seeking for renewal of consent, which will be considered in accordance with law. 5. Admittedly, the petitioner has not challenged this order dated 08.12.2025 and instead, he has come with the present writ petition https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis
WP No.32739 of 2026 seeking for a direction to allow the petitioner to upload the renewal application dated 09.11.2025. 6. It is the only submission of learned counsel for the petitioner that though the petitioner had gone before the Assistant Director of Survey and Land Records seeking for subdivision of the land in T.S.No100, the same was not successful, as they have insisted for an NOC from the HR & CE Department. If at all, the Survey Department has insisted for NOC, it is for the petitioner to approach the HR & CE Department and submit necessary NOC or proceed against the Survey Department, if the petitioner feels otherwise he is entitled to. However, without following the procedure by obtaining the subdivision of the land nor challenging the order dated 08.12.2025 issued by the Pollution Control Board, the petitioner has preferred this writ petition seeking for a direction to upload the renewal application. 7. When admittedly the land in T.S.No.100 stands in the name of a temple and when complaints are received, it is for the petitioner to obtain necessary subdivision records and apply for renewal through online portal, as ordered by the Pollution Control Board vide proceedings dated 08.12.2025.
