The case of the prosecution is that the defacto complainant who is a B.Com., student in Karpagam College, staying along with his friends in a rented house. On 03.03.2026, at about 11.00 p.m., the petitioner along with the co- accused entered into the house of the defacto complainant and threatened them with knife and robbed their mobile phones and laptops, resulting in the registration of a case. 3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He further submitted that there are totally seven accused involved in this case, out of which, three of them were released by this court and three were released by the trial court. He further submitted that the petitioner was arrested and still in judicial custody since 04.03.2026 and the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that there are totally seven accused, in which this petitioner in FIR was arrayed as A2 and now in PRC, the petitioner has been arrayed as A1. He further submitted that the petitioner is having three previous cases pending https://www.mhc.tn.gov.in/judis CRL OP No. 22256 of 2026 __________ Page3 of 6 against him and the investigation has been completed in this case. However, he opposed the grant of bail to the Petitioner. 5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record. 6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); considering the totality of the circumstances and the petitioner is is continuous custody since 04.03.2026, and that other accused were already released on bail, that investigation has been completed in this case, this Court is of the view that further custody for the purpose of investigation is not required. Hence, this Court is inclined to grant bail to the petitioner. 7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned District Munsif-cum-Judicial Magistrate Court, Madukkarai, Coimbatore, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship https://www.mhc.tn.gov.in/judis CRL OP No. 22256 of 2026 __________ Page4 of 6 [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall appear before the trial court everyday at 10.30 a.m., until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 18-08-2026 GV Note: 1.
