ORDER This Original Petition has been filed by the petitioner/father under Sections 3, 7 to 10 and 25 of the Guardians and Wards Act, 1890, read with Order XXI, Rules 2 and 3 of the Original Side Rules, seeking: a) to grant permanent custody of the minor child, A.V. Addhwick, aged about 2 years and 7 months, to the petitioner; and b) to appoint the petitioner as the legal guardian of the person of his minor son, A.V. Addhwick, aged about 2 years and 7 months. 2. The petitioner, M. Arun Joshua, is the father of the minor child and the respondent, A.M. Vandhitha, is the mother. The marriage between the parties was solemnized on 02.07.2021. Out of the said wedlock, the minor child, A.V. Addhwick, was born on 11.05.2023. 3. It is seen from the records that earlier, this Court, by order dated 08.04.2026, had referred the matter to the Mediation and Conciliation Centre, High Court, Madras. Accordingly, the parties appeared before the Mediation and Conciliation Centre, High Court, Madras, and arrived at a compromise and https://www.mhc.tn.gov.in/judis A No. 1344 of 2026 __________ Page3 of 4 entered into a Settlement Agreement/Parenting Plan dated 12.08.2026. 4. As per the Settlement Agreement/Parenting Plan dated 12.08.2026, the petitioner/father has agreed to permit the respondent/mother to act as guardian of the minor child, A.V. Addhwick, and to take decisions relating to the welfare and upbringing of the minor child. 5. In view of the terms contained in the Settlement Agreement/Parenting Plan dated 12.08.2026, this Original Petition is disposed of by recording the said settlement. The terms of Settlement Agreement/Parenting Plan dated 12.08.2026 shall form part and parcel of this order. No costs.
