For Petitioner(s): Mr.G.Ezhilbalaji For Respondent(s): Mr.M.M.I.Khaleel Government Advocate (Criminal Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 26.06.2026 for the alleged offences under Sections 126(2), 296(b), 309(4), 311, 351(3) in Crime No.443 of 2025 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner, along with other accused persons, waylaid the defacto complainant and demanded money. Upon refusal, the accused persons allegedly robbed a sum of Rs.550/- at knife-point. https://www.mhc.tn.gov.in/judis CRL OP No. 22613 of 2026 __________ Page2 of 4 The case was taken on file as S.C.No. 834 of 2025 and is pending before the XVII Additional District and Sessions Court, Chennai. Owing to the absence of the petitioner, a Non-Bailable Warrant (NBW) was issued against him on 22.06.2026. In pursuance thereof, he was arrested on 10.07.2026 and remanded to judicial custody. 3. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He states that due to a serious physical illness, the petitioner was unable to appear before the trial court. It is further submitted that the petitioner is a dialysis patient undergoing continuous medical treatment. The learned counsel would further submit that the petitioner has been in judicial custody since 10.07.2026 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for the grant of bail. 4. The learned Government Advocate (Crl.Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and on instructions, submitted that the petitioner has thirteen previous cases. 5. Considering fact and circumstances of the case, the submission of the learned Government Advocate (Crl.Side) that the petitioner has thirteen previous cases, this Court is not inclined to enlarge the petitioner on bail. 7.
