Present bail application is moved by the applicant, who is in judicial custody in connection with Case Crime No.40 of 2022, S.S.T. No.02 of 2023 under Section 3(1) of U.P. Gangsters and Anti-Social Activities (Prevention) Act, Police Station Rudrapur, District Udham Singh Nagar. 4. Learned counsel for the applicant submits that applicant is an innocent person and has falsely been implicated in the present case; applicant is languishing in jail since 24.02.2022. He submits that applicant Rajesh Gangwar, Annu Gangwar @ Manoj Kumar @ Gulab Singh and Vinay Verma @ Bantu have been enlarged on bail the Coordinate Bench of this Court by this Court vide orders dated 01.05.2023, 11.10.2023 and 27.12.2023. He submits that on the ground of parity applicant is entitled to be enlarged on bail. 5. Learned State Counsel has strongly opposed the bail. However he admits the fact of parity. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Jay Kumar @ Jayka be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 8.
