ANAND VENKATESH CRP No. 4945 of 2026 and CMP No.21599 of 2026 G.Manoharan ….Petitioner(s) Vs S.V.Jayadevan ...Respondent(s) PRAYER Petition filed under Article 227 of the Constitution of India, to set aside the fair and decreetal order dated 30.06.2026 passed in IA No.10 of 2026 in OS No.270 of 2019 on the file of the Additional Subordinate Court, Mayiladudurai. For Petitioner(s): R.Hemalatha ORDER This Civil Revision Petition has been filed under Section 227 of the Constitution of India against the fair and decreetal order passed in IA.No.10 of 2026 in OS.No.270 of 2019, on the file of the Additional Subordinate Court, Mayiladudurai, dated 30.06.2026, wherein the application filed by the petitioner/plaintiff to reopen the case came to be dismissed by the Court below. https://www.mhc.tn.gov.in/judis 2 CRP No. 4945 of 2026 2.The petitioner who is the plaintiff filed the suit in OS.No.270 of 2019, seeking for the relief of recovery of money The evidence was complete and the case was at the stage of final arguments. At this stage, IA.No.10 of 2026 came to be filed to reopen the case on the ground that the petitioner wanted to summon the muster roll from the Neyveli Lignite Corporation (NLC) and to examine the concerned witness in order to establish the claim made by the petitioner. The Court below dismissed this application by an order dated 30.06.2026. Aggrieved by the same, the present Civil Revision Petition has been filed before this Court. 3.This Court heard the learned counsel for the petitioner and carefully went through the materials available on record. This Court also went through the order passed by the Court below. 4.In the considered view of this Court, the suit is of the year 2019 and the suit was at the stage of final hearing. The petitioner wanted the case to be reopened to examine the concerned official from NLC. The Court below found that no useful purpose will be served by reopening the suit at the fag end and it will not in any way substantiate the case of the plaintiff. The reasoning given by the Court below does not suffer from any perversity warranting the interference of this Court in exercise of its jurisdiction under Article 227 of the Constitution of India. https://www.mhc.tn.gov.in/judis 3 CRP No. 4945 of 2026 5.In the result, this Civil Revision Petition is dismissed.
