[2] At the outset, the learned counsel appearing for the petitioner submitted that the present writ petition can be disposed of by issuing a simple direction to the respondents that no eviction proceedings, as alleged in this writ petition, shall be taken up by the respondents without following due process of law. [3] The learned counsel appearing for the petitioner accordingly prays for disposing of this writ petition by issuing such a simple direction to the respondents. [4] Mr. Shyam Sharma, learned GA appearing for the respondents fairly submitted that it is settled law of the land that any eviction proceeding cannot be taken up by the authorities without following due process of law. The learned GA accordingly submitted that the present writ petition can be disposed of as prayed for by the learned counsel appearing for the petitioner. [5] Considering the submission made by the learned counsel appearing for the parties and on perusal of the record, this Court is of the considered view that it will meet ends of justice to issue the following directions:- WP (C) No. 488 of 2026 Page 3 (i) The respondents are hereby directed not to initiate any eviction proceedings, as alleged in the present writ petition, without following due process of law. (ii) It is made clear that the above direction has been issued without touching upon the merit of the present writ petition. [6] With the aforesaid directions, the present writ petition as well as the connected application are hereby disposed of. JUDGE Sapana
