With the consent of both the parties, the writ petition is disposed of at the admission stage. 3. The claim of the petitioner in the present writ petition is for payment of the amounts due and payable to the petitioner towards encashment of Earned Leave along with interest thereon. 4. According to the petitioner, there is no dispute about the entitlement of the petitioner for the said amount. The third respondent society is not releasing the amount on the ground of financial crisis and therefore, the petitioner approached the District Collector, Perambalur and made a representation before the Public Grievance Redressal Day seeking appropriate directions for consideration of the said representation dated 18.05.2026. However, this Court, having considered the submissions made on either side, is of the considered view that the present writ petition filed seeking relief against the third respondent society is not maintainable, https://www.mhc.tn.gov.in/judis WP No. 32925 of 2026 __________ Page3 of 4 as the petitioner neither comes under the Common Cadre Service Rules nor is there any allegation of violation of any statutory provision. 5. In the light of the above, the writ petition cannot be entertained against the third respondent herein in view of the decision rendered by the Hon’ble Full Bench of this Court in the case of “Marappan -vs- Deputy Registrar of the Cooperative Societies, Namakkal Circle” reported in (2006) Vol 6 CTC 689. However, this Court deems it appropriate to relegate the petitioner to avail the remedy under Section 153 of the Tamil Nadu Co-operative Societies Act, 1983, within a period of four weeks from the date of receipt of a copy of this order. On filing of such revision petition by the petitioner under Section 153 of the Tamil Nadu Co-operative Societies Act, 1983, the first respondent shall consider the same on its own merits, without reference to the period of limitation, and pass appropriate orders thereon as expeditiously as possible, at any rate, within a period of eight weeks from the date of receipt of such revision petition. 6. With the above directions, the writ petition is disposed of. No costs.
