Ms.Bandi Praveena, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is a law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, he prays that the present petition be allowed. 3. Per contra, Ms.P.Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner and submitted that though the charge sheet has already been filed in the case, the accusations against the petitioner are well founded. Hence, he urged that the petition be dismissed. 3 Dr.YLR,J Crl.P.No.5701 of 2026 Dated 20.07.2026 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, after a thorough investigation, the charge sheet was filed within the statutory period. The petitioner was arrested on 06.04.2026 and has been in judicial custody for the past 106 days. The contraband allegedly seized from the petitioner is 5.096 kgs of ganja. It is also evident from the record that the petitioner is a rowdy sheeter. There are seven adverse antecedents reported against him, out of which five are of a similar nature. The allegation against the petitioner is that he used to procure ganja and sell the same within Visakhapatnam City. In view of the filing of the charge sheet and the material collected in the course of investigation, the accusations against the petitioner are prima facie well founded. 6. Having regard to the entire facts and circumstances of the case, the specific accusations levelled against the petitioner, which are prima facie well-founded in the charge sheet, the nature and gravity of the offence, this Court is not inclined to enlarge the petitioner/Accused on bail at this juncture. Accordingly, this Court finds no merit in the Criminal Petition, and the same is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed. 4 Dr.YLR,J Crl.P.No.5701 of 2026 Dated 20.07.2026 As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR.
