Suryanaryanan For R1 __________ Page1 of 4 https://www.mhc.tn.gov.in/judis CRP No. 4190 of 2026 ORDER This Civil Revision Petition has been filed challenging the Docket order made in RM No.10 of 2025 in OS No. 344 of 2009 dated 13.10.2025 by the District Munsif, Arani, closing the application seeking return of original documents, inview of pendency of the second appeal in S.A.No.671 of 2025 before this court. 2. Heard the learned counsel for the petitioners and the learned counsel for the 1st respondent. 3. When the matter was listed on 31.07.2026, after hearing the petitioners, I directed the petitioners to file an undertaking affidavit that they would undertake to produce the original documents, in the event of same being required by this court in the second appeal. 4. Today, Mr.A.D.Baskar, the first petitioner herein filed an affidavit of undertaking for himself and on behalf of the 2nd petitioner namely R.Santhi, his sister, undertaking to produce the original documents, if returned as prayed for by him in R.M.No.10 of 2025 by the District Munsif, Arani, in the event of this court requiring the same for scrutiny in S.A.No.671 of 2025. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis CRP No. 4190 of 2026 5. Recording the above undertaking affidavit, I am inclined to set aside the order passed by the Trial Court. 6. Accordingly, this civil revision petition is allowed and the order passed by the Trial Court in R.M.No.10 of 2025 in O.S.No.344 of 2009, dated 13.10.2025 is set aside. The petitioners shall be entitled to the return of original documents as prayed for in in R.M.No.10 of 2025 in O.S.No.344 of 2009, subject to the undertaking affidavit that is being taken on file today.
