GP FOR SOCIAL WELFARE 2 The Court made the following order: Heard Sri P.R.K.Amerandra Kumar, learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondents. With the consent of both the learned counsel, the writ petition is disposed of at the stage of admission. 2. The present Writ Petition is filed challenging the action of the 3rd respondent in interfering with the possession and enjoyment of the subject land over an extent of Ac.1.00 cent in R.S.No.2, situated at Gangannagudem Village, Jeelugumilli Mandal, Eluru District. It is further contended that the respondents are proposing to evict the petitioner from the subject land in violation of the provisions of the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959 (Regulation 1 of 59). 3. It is contended that the petitioner belongs to the Scheduled Tribe (ST) community and that the subject land originally belonged to his forefathers. Thereafter, the petitioner's father inherited to the subject property, after the death of petitioner’s father, the petitioner had succeeded to the same. Thereafter, the petitioner approached the 3rd respondent for mutation of his name in the revenue records. The name of the petitioner was mutated in the revenue records and issued Pattadar Pass Book and Title Deed in his favour. 4. It is further submitted that the respondents are proposing to evict the petitioner in order to assign the subject land for the rehabilitation of project- displaced persons. The said action is said to be contrary to the provisions of the aforesaid Regulation. Hence, the petitioner seeks a direction to the 3 respondents not to interfere with the possession and enjoyment of the subject property. 5. Today, when the matter is taken up for consideration, learned Assistant Government Pleader for Social Welfare appearing for the respondents has placed before Court a copy of the written remarks dated 22.07.2026 received from the 3rd respondent. A perusal of the same reflects as follows: “4. It is further submitted that the official respondents from Revenue Department never interfered into the possession of the subject lands. This respondent never issued any order/direction/proceedings with regard to the subject land that may be construed as interference or an act of eviction of the petitioner from the subject land. 6. It is further submitted that no land acquisition proceedings have been initiated in respect of the petition schedule land. Moreover, even if any land acquisition proceedings are undertaken in future, disputed lands such as the petition schedule land would not be considered for acquisition.” 6. The written remarks dated 22.07.2026 of the 3rd respondent are placed on record. 7. In the light of the foregoing, as the grievance of the petitioner is addressed, no further orders are required to be passed. 8. Accordingly, the Writ Petition is disposed of.
