05.02.2026 Court No.28 Item No.51 tbsr Reject CRM (A) 196 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Barasat Cyber Crime P.S. Case No.44 of 2025 dated 19.09.2025 under Sections 316(2)/318(4)/319(2) of the BNS, 2023. And In the matter of: Masoom Ahmed ….Petitioner. Mr. Samrat Banerjee ….for the petitioner Mr. Anand Keshari Mr. Pratick Bose ….for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner is a victim of circumstances. Some amount of money was credited from an unknown source to his account. He is a daily labour. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that this is a case of Cyber Crime. Several persons are involved and there are several victims in this case. Money did not only get credited to the bank account of the petitioner, but also was withdrawn on the same day in cash. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
