ORDER The petitioner, who was arrested and remanded to judicial custody on 13.03.2026 for the alleged offences under Section 294(b0, 310(2), 311 of BNS, in Crime No.50 of 2026 on the file of the respondent police, seeks bail. https://www.mhc.tn.gov.in/judis

2. The allegation against the petitioner is that, on 03.03.2026, at about 21.30 hours, while the de-facto complainant and his friends were at their house, all the accused came to the place of occurrence in three two-wheelers. A1 and A2 entered the house, threatened the de-facto complainant and his friends with a knife, and robbed Rs.6,500/- in cash and through online transactions, along with one laptop. Thereafter, the fled from the spot. Hence, this case.

The learned counsel for the petitioner submitted that this is the first bail application filed by the peittioner and he had filed bail petition before the Principal District Judge, Coimbatore in Crl.M.P.No.2494 of 2026 and the same was dismissed on 24.07.2026. He further submitted that the petitioner has been incarcerated since 13.03.2026. He further submitted that investigation has been completed and charge sheet has been filed. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation has been completed and the charge sheet has been filed. He further submitted that two previous cases are pending against the petitioner, out of which one is similar in nature and other the other is under the Arms Act. 5. I have given my anxious consideration to the submissions made by the
learned counsel on either side and perused the materials available on record. 6. Considering the nature and gravity of the offence, the fact that the investigation has been completed and the charge sheet has been filed, and taking note of the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner, subject to the following conditions:-

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned District Munsif-cum-Judicial Magistrate Court, Madukkarai, Coimbatore, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the trial Court daily at 10.30 a.m, until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; https://www.mhc.tn.gov.in/judis
CRL OP No. 23598 of 2026 __________ Page4 of 5 [e] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 24-08-2026 nvi Note:
