BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 19.05.2026 Heard Mr. F Khan, the learned counsel appearing for the applicant. Also heard Mr. K Baishya, the learned Additional Public Prosecutor appearing for the State of Assam- respondent.
2. This is an application under Section 430 (2) of the BNSS, 2023 praying for suspension of sentence and for allowing the applicant to go on bail.
3. 2.176 kilogram of ganja was recovered from the possession of the applicant and he was convicted under Section 20 (B) of the NDPS Act.
4. The applicant was sentenced to undergo rigorous imprisonment for five years and also to pay fine of ₹50,000/- by the learned Special Judge, Bongaigaon in Special (Nar) Case No.16/2021.
5. I have gone through the judgment passed by the trial court. I have also considered the submissions made by the learned counsels of both sides.
6. It is hereby directed that the sentence imposed upon the applicant, Raj Kumar Sah by the learned Special Judge, Bongaigaon in Special (Nar) Case No.16/2021 shall remain suspended till disposal of the connected appeal.
7. The applicant, namely, Raj Kumar Sah is allowed to go on bail of ₹25,000/-
Page No.# 3/3 (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the learned Special Judge, Bongaigaon.
